Same Sex Marriage License Update
Sharon R. Bock, Esq., Clerk & Comptroller Palm Beach County remains ready to issue same sex marriage licenses upon clarification by the Court.
WEST PALM BEACH, FLA. (December 31, 2014) – Late this afternoon we received the Petition and Order signed by the Orange County Circuit Court Judge authorizing the Orange County Clerk to issue same sex marriage licenses beginning January 6.
Because the Clerk from Washington County Florida filed an Emergency Motion for clarification and Judge Hinkle acted on it in an expedited manner, we have reason to believe that this issue will be clarified by the Federal Court prior to January 6. This Federal Court’s ruling on this issue would be a final binding judgment.
As noted in the order signed by the Orange County Judge: “This order shall remain in effect unless modified by a subsequent ruling from the Federal District Court in the Brenner, supra case or subsequently modified by a court of competent jurisdiction.”
Clerk Bock is prepared to file a petition by Friday January 2, should we not have a ruling by the Federal District Court prior to this date. The Palm Beach County Clerk has been preparing for the issuance of same sex marriage licenses and will begin issuance as soon as a final binding judgment is received.
