An appeal is a legal process by which a higher court is asked to review the trial court’s or administrative court’s record and rule on the legal issues.

Appeals from a Circuit Civil case are heard by the 4th District Court of Appeal (4th DCA).

Appeals from a County case are mostly heard by the 4th District Court of Appeal (4th DCA). Only certain cases are heard by the Circuit Court per Florida Statutes. Learn more here.

Appeals Process - Civil

  • Submit Notice of Appeal
    You must file a “Notice of Appeal” with the Clerk of the Circuit Court & Comptroller to let the lower court know you are filing an appeal, along with the filing fee.

  • To obtain a “stamped” copy for your records:
    If you would like a filed stamped copy of your Notice of Appeal for your records, you must provide a copy along with the original Notice of Appeal to the Clerk of the Circuit Court & Comptroller.

  • Sending “Notice of Appeal” to the 4th DCA:
    The Clerk of the Circuit Court & Comptroller will make a certified copy of the original Notice of Appeal and will send it along with your payment to the 4th District Court of Appeal.
