Addendum to Administrative Policy 11-01

Starting August 5, 2013, the Clerk of the Circuit Court & Comptroller’s office will be open to the public from 8:00 a.m. to 4:00 p.m. Monday through Friday. Consistent with the new business hours, the following changes to Administrative Policy 11-01, “Clerk’s Judicial Sales Procedure,” will take effect August 5, 2013:

Viewing the Files: Foreclosure files are available for viewing at public viewers during the hours the office is open to the public in the Circuit Civil File Room, Room 3.2300.

Payment of Deposit: Deposits made by cash, cashier check or attorney trust account check must be presented to the Foreclosure Department by 4:00 p.m. the business day before the scheduled auction you intend to bid in.


Addendum to Judicial Sale and Tax Deed Sale Administrative Policies: Club Memberships

Bidders are solely responsible for thoroughly researching the properties for which they intend to bid. The Clerk makes no representations or warranties as to the condition of the properties being sold, including whether properties are subject to any liens, encumbrances, or taxes.

Properties located within common interest communities, such as gated communities, condominium associations, and cooperatives may be subject to certain covenants including MANDATORY CLUB MEMBERSHIPS requiring an initial membership equity fee and annual dues. These fees can be significant and are in addition to the purchase price paid to the clerk at the auction. It is the bidders’ sole responsibility to determine whether properties are subject to any covenants, conditions, or restrictions, including mandatory club memberships, prior to placing their bid. The Clerk sells properties pursuant to statute or court order and does not have information regarding encumbrances. Bidders should consult with an attorney or title company regarding any restrictions or mandatory memberships to which properties may be subject.


Revised Second Addendum to Administrative Policy 11-01: Property Addresses and Property Appraiser's Website

The street address of any listed property is provided by the Plaintiff or Grant Street Group and is not verified by the Clerk. The Clerk of the Circuit Court & Comptroller is not responsible for the accuracy of any such address. The street address alone should not be relied on by a bidder to identify the property.

Information on the Property Appraiser’s website is not verified nor maintained by the Clerk. The link to such website is provided by Grant Street for bidder convenience only.


Third Addendum To Administrative Policy 11-01: Online Sale Fee

Section 7 of Senate Bill 2506 was signed by the Governor on June 16, 2017 and amended Florida Statute Section 45.035(3), effective upon signing, as follows:

“If the sale is conducted by electronic means, as provided in s. 45.031(10), the clerk shall receive an additional service charge not to exceed $70 for services in conducting or contracting for the electronic sale, which service charge shall be assessed as costs and paid when filing for an electronic sale date…” (emphasis added).

Accordingly, the $60 online sale fee due to the Clerk for conducting the foreclosure sales electronically shall be assessed and paid by the plaintiff and not the winning bidder on all Final Judgments and Orders signed by the Judge after the effective date of Senate Bill 2506. Such fee shall be due upon granting of such Final Judgment or Order.


Fourth Addendum To Administrative Policy 11-01: Online Sale Fee

Effective January 1, 2018 the plaintiff is to pay the clerk a $ 70 online sale fee, for conducting the online foreclosure sale.
