  • Pay the fine of $264.
  • Plead Not Guilty in writing, submit it to any Clerk of the Circuit Court & Comptroller office location, and request a court date. At the court hearing, if you are found guilty of the offense, the court may assess a penalty up to $500, plus court costs of $106.
  • File an exemption affidavit. If you are the registered owner of the vehicle, you are deemed responsible for the penalty unless, in compliance with Florida Statute 316.0083(1)(d)(1)-(4), you establish by a notarized affidavit that a statutory exemption applies.
